Per the ACCME, individuals who are owners or employees of ineligible companies have financial relationships that cannot be mitigated. There are three exceptions the ACCME provides.

There are three exceptions to this exclusion—employees of ineligible companies can participate as planners or faculty in these specific situations:
a. When the content of the activity is not related to the business lines or products of their employer/company.
b. When the content of the accredited activity is limited to basic science research, such as pre-clinical research and drug discovery, or the methodologies of research, and they do not make care recommendations.
c. When they are participating as technicians to teach the safe and proper use of medical devices, and do not recommend whether or when a device is used.

Please provide the following information NO LESS than two weeks prior to the start of your educational activity. Describe how the content is wholly and completely unrelated to the business lines or products of the ineligible company for which the speaker has ownership or is employed by. For example, Company A employees speaker B and speaker C. Company A makes, cardiovascular, oncology, diabetes, and nephrology drugs. Speaker B is presenting on ethical considerations in clinical research. Speaker B’s content is not related to any of company A’s business lines. Therefore, the speaker B meets the exception. Speaker C is presenting on innovations in oncology. Speaker C’s content is related to company A’s business lines. Therefore, Speaker C does not meet the exception.
Describe how you will ensure the content of the accredited activity is limited to basic science research, such as pre-clinical research and drug discovery, or the methodologies of research, and they do not make care recommendations. “Basic science research" emphasizes laboratory studies, and may include components of cell cultures, physiologic experiments, animal studies, pre-clinical research, drug discovery, methodologies of research (without clinical care recommendations). Any research that involves human subjects/human applicability is not considered basic science research.  Instead, it would be considered "Basic Experimental Studies involving Humans (BESH)". Phase I-III human studies are considered BESH, not basic science.
Describe how you will ensure no recommendations as to whether or when the device discussed in this content is used.
